The Failure of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension caused by the presentation of a new 28-point plan for resolving the conflict appeared – temporarily – to have been defused. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its response: a renewed assault of aerial bombardment on Kyiv.

The Pattern of Negotiation and Warfare

The succession of conflicting incidents captured the grim essence of the recent timeframe. By day, political struggles are conducted: positive announcements are released from multiple capitals. Immense energy is allocated on managing specific proposals. By night, Moscow brutally reminds the world that, for them, war remains the primary tool for achieving "resolution".

Nocturnal Warfare

As military strikes unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is able to track projectile deployments from across the border, a capacity enabled by timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to intercept incoming aerial threats roared overhead – sophisticated military planes delivered to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: multiple launches fired to intercept a incoming threat. This was a modern interception technology at work, probably delivered by partner states. Every launch shakes the surroundings, rattling buildings. The moment of terror quickly becomes grim resignation: perhaps the hostile projectile won't hit its mark this time, protecting urban areas from catastrophe and additional electricity failures.

Continuous Dangers

Not long after, a large-caliber weapon opened up on a unmanned aircraft close by, part of a mobile-fire group – most likely imported technology. Regrettably, the bullets missed the enemy aircraft – it pressed on overhead toward its target.

Intermittently, this persisted until dawn. Kyiv greeted the morning news: multiple fatalities, damage and infrastructure problems in multiple buildings as a result of the night's assault. As always, everyone still maintained normal activities – enduring hostilities. But those 24 hours demonstrated Ukraine's critical military reliance on external assistance – a reliance that regional partners are evidently unprepared to substitute in the short term.

Ineffective Peace Efforts

The 28-point plan from US administration generated strong feelings, controversy and profound anxiety – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and multilateral gatherings.

Every new approach from American administration unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually secure success. This cycle will, undoubtedly, continue.

Tactical Assessments

It is easy to blame particular leaders of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. US administration functions according to a premise familiar among international relations experts: you cannot secure via talks what you have lost on the battlefield. The American government believes that it is impossible to pressure the Kremlin to abandon the territory that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, Washington does minimal to deter Moscow, through diplomacy or military means, from assuming that the status quo will not change more in its benefit in the months ahead.

Divergent Views

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its allies are nearing depletion. Their reason to agree to terms that does not give them the greatest potential benefit is close to zero. There may be numerous efforts to end hostilities, but they will persist as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding lives and land but avoiding a total frontline collapse until circumstances change in its favour.

Present Conditions

Realistically, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: political desires to broker a ceasefire and secure international recognition, and the government's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the national cause against any initiative Kyiv finds unacceptable, so that their focus does not move to domestic problems. And although their objective will now be significantly challenging after latest incidents, it remains quite doubtful that this will modify their basic position.

These conflicting dynamics are influencing discussions.

Summary and Prospects

It took a mere seven days to terminate the suggested clauses of the latest plan. Assertive and inconsistent approach of the matter by US administration, resistance by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, current information leaks, all served their function.

While new initiatives based on previous concepts are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are founded on Moscow's terms and demonstrate specific hesitation to change the course of events, if they stand together and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, largely rely on ongoing international assistance.
